Not too clued up on record contracts that much... How much of a say does Biffy actually have. I've friends on facebook slagging biffy off for selling out. Is that fair? Was under the impression that if it's in their contract that Sony or whoever have control of the rights then there's nothing Biffy could have done about it....

I hate this concept about bands selling out. The way the music climate is at present, this is probably there only chance to write a number 1 single, definitely to write a christmas number 1. They would be mad to turn down the exposure. I think they deserve to be running all the way to the bank, I have seen them play in small clubs to 20 people, they have defintely put the slog in. I dont see anything wrong with them wanting the financial reward. People say they are not poor, however they are financially far less well off than footballers who sell their souls to nike and adidas. Anyone who stops liking their music because they let one of their songs on x factor is a bit sad

Yeah I agree. I don't have a problem with bands selling out in this kind of way. They'll still keep their musical and artistic integrity if they continue to write music that is true to themselves. I have more of a problem with bands that reduce their own output to lowest denominator spluge (e.g. KoL).

It was more a case of wondering how record contracts work and if Biffy actually had any say in this or not...?

I would argue that biffy clyro have been releasing songs aimed at the mainstream since the start such as 57 and justboy. They may not have got them commerical success but they are no less commerecial sounding than recent releases. So I am not sure they can really be accused of selling out as they have always had a mix of mainstream and heavier more experimental songs.

Apparantly a quote from Simon Neil earlier this year :

Even though the original songwriter may own the intellectual rights to a song, he or she may not be in a position to control all of the possible uses of that song. Songwriters and musicians under contract to a studio may have to relinquish certain rights to a song as part of their agreement. In that case, the studio itself may assume certain rights to a song, particularly when it comes to derivative works such as sampling, covers by other artists and compilation albums. Songs created by artists while under contract to a studio may be considered "work product," in the same sense that an engineer working for NASA or General Electric could not claim a patent for an invention created on company time.

This is how I feel as well. I don't think anyone can doubt they've sold out, in quite a large way. But personally I couldn't give a shit. If they rate money over integrity then fair play to them.

The only thing I would say and have already pointed out, with them doing this they are giving their song away. To the general public it won't be a Biffy song anymore, it'll be a Matt Cardle song. I'd go as far as saying some idiots will believe that Biffy's version is a cover! It's happened before. If they can take that then fair enough.
