"Ospreys have been known to breed at Strathallan, either on or close by the development site,

for a number of years. The potential worst case impact on osprey would not affect the

favourable conservation status of the species in Scotland.

The prime consideration is the protected status of osprey within Schedule 1 of the Wildlife and

Countryside Act 1981 (as amended) and the risk of disturbance in contravention of Section 1

(5):

(5) Subject to the provisions of this Part, if any person intentionally or recklessly

(a)disturbs any wild bird included in Schedule 1 while it is building a nest or is in, on or

near a nest containing eggs or young; or

(b )disturbs dependent young of such a bird,

he shall be guilty of an offence.

In response, an osprey management plan (latest version dated 18th February 2015) has been

drawn up for the applicant by a recognised expert on the species. It proposes the re-siting of

the osprey nest farther away from the main stage. We acknowledge and respect the

contractor’s expertise and long experience with this species and note his confidence in the

success of the proposed relocation. Whilst the new location is still less than the minimum

buffer distance of 750m set out in our guidance, we agree that it should be effective as the

intervening topography and woodland cover should provide some additional protection from

visual and noise disturbance. Steps should be taken to minimise disturbance at this new nest

site throughout the period of preparation and the event in order to maximise the likelihood of

successful breeding.

Whilst we agree that the proposed relocation is likely to be effective if ospreys use it, we

advise that there remains a risk that the high levels of noise and the lighting effects during the

event phase could still cause disturbance in practice. Disturbance is also possible if the

ospreys reject the new nest and choose instead an alternative location closer to the main

disturbing activities.

As a consequence we recommend that any planning consent includes a condition requiring

the implementation of the osprey management plan; adequate monitoring of its effectiveness

in the setting up period, during the running of the event and its tidy up, and also identifies

proposals for alternative action if, for any reason, the plan is found to be unsuccessful in

preventing disturbance in practice."

The current osprey nest is located on the edge of the proposed ‘event arena’. The nest fledged

three chicks in 2014 and as far as we are aware, has been used for at least five years.

Ospreys are protected under Schedule 1 of the Wildlife & Countryside Act (as updated 2004). It

is therefore an offence to ‘intentionally or recklessly disturb an osprey whilst it is building a nest

or is in, on, or near a nest containing eggs or young.’ SNH has advised that a disturbance

distance of up to 750m from the nest should be applied in this instance (Ruddock and Whitfield,

2007) and the impact of any activities within this distance of an active nest should be

considered.

In supplementary information, DFC have proposed to remove the current nest, lop the top of this

tree to make it unsuitable for nesting and erect a new nest a further 300m away, prior to the

ospreys’ return. We understand that the lopping of other trees on site is no longer proposed. We

note that the ornithologist advising on the location and construction of this nest has extensive

experience in moving osprey pairs up to 600m away to new nest sites and is confident of

success.

Whilst the location of the new nest is still within 750m of the main stage, it is at the top end of

advised disturbance distances and intervening woodland and topography may provide

additional protection. We also note that no heavy traffic will pass close by the new site and no

fencing is due to be erected within 400m. If used by the birds, such mitigation will reduce

impacts on osprey and will offer an opportunity to keep them within the local area. It will be

essential that this is secured through condition and that the site is closely monitored by the

Council to ensure compliance.

It should be noted that whilst reduced, disturbance may still occur due to the unique nature of

the event involving high levels of noise and lighting.

There is also a chance that the birds may reject the new nest site and chose a tree closer to

disturbing activities. If this occurs an infringement of their legal protection may still occur. We

welcome that daily surveys will occur from the 15 March onwards and that these include all

suitable trees within a 750m buffer around the site (figure 10.2). It is not clear from any of the

information provided what action the applicant or consultants will take if nest building begins in

another tree."

Well that's the hope, most likely scenario I can imagine is that it just takes place at Ballado for another year.

Thats exactly what I was thinking but they will have to get a move on as time is against them. I am confident it will go ahead as the consciences of it not happening at all will be a disaster for the festival.

Well they wouldn't be starting to get the site ready at Strathallen until next month anyway so should be plenty of time to get Ballado ready.

What does this all mean?

If the ornithologist can successfully relocate the ospreys nest, which he has done before, to another tree that it's an acceptable distance from the main arena then the concerned parties won't object as long as continued monitoring of the ospreys is carried out.

If they move the nest and the ospreys don't want to move to the new nest.... Fck knows.

I'm still 95% certain that it will go ahead.

Theres no way a big event like T wouldn't have some sort of back up plan. I guess he said they didn't have one just to reassure the people around that area that they are fully committed to making it

work at strathallan in the long term and that they would get it to work. If you say yes we have a back up plan then people will assume there no confidant about certain things and will start to have doubts. DF concerts and Geoff Ellis arent stupid they will definitely have a plan b up there sleeve.

The pipeline has always been an issue at balado.Another year isn't going to make a difference.

I'll be amazed if it doesn't go ahead at Strathallan.

I posted a comment on the TITP FB page asking what the nesting Ospreys mean for TITP at Strathallan. Within 10 mins they had deleted by post.

Could someone else ask the question on their FB page, Surely they can't delete everyone's post? If enough people ask the question they have to answer.
